Legal Terms of Service, User Agreements & Regulatory Compliance under Indian Central and Maharashtra State Laws
💳 STRICT 100% CASHLESS PLATFORM MANDATE — NO CASH ON DELIVERY (ZERO COD)
QuickDine operates as an exclusively 100% prepaid digital platform. Cash on Delivery (COD) and physical cash payments are strictly disabled and prohibited across all service verticals (Food Delivery, Parcel Courier, and Bike Taxi). All orders and rides must be paid digitally via authorized UPI, Net Banking, Debit/Credit Card, or In-App Wallet before dispatch. Customers must NEVER pay cash to delivery partners or captains, and partners are strictly barred from soliciting or accepting physical cash.
1. Intermediary Status & Platform Role
The platform is an electronic marketplace and intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000. We operate three specialized service verticals:
- Food Delivery: Connecting consumer patrons with licensed Food Business Operators (Restaurants/Cloud Kitchens) and independent logistics partners.
- Parcel Logistics: Providing point-to-point intra-city document and package delivery as a digital aggregator and Common Carrier facility.
- Bike Taxi Aggregator: Onboarding authorized two-wheeler transport operators to connect riders with passengers for short-distance transit.
2. Food Delivery & FSSAI Compliance
- Statutory FSSAI Registration: Every listed restaurant partner must hold a valid 14-digit FSSAI Registration or License under Section 31 of the Food Safety and Standards Act, 2006. Their license number is published on their store card and digital invoices.
- Hygiene & Quality Responsibility: Under Section 26 of the FSS Act, food preparation, hygienic cooking, safe ingredients, and shelf-life are the sole responsibility of the merchant restaurant.
- Tamper-Evident Packaging: Restaurants are obligated to package food in tamper-evident sealed bags. Delivery partners are strictly prohibited from opening, inspecting, or tampering with food containers.
- Veg / Non-Veg & Allergen Declarations: All menu listings feature statutory Indian food safety green (Vegetarian) or brown (Non-Vegetarian) badges.
- Section 9(5) CGST Act Compliance: In accordance with Notification No. 17/2021-Central Tax (Rate), the platform collects and directly remits 5% GST to the Government on restaurant services rendered through the application.
3. Parcel Delivery & Carriage by Road Rules
Parcel operations are governed by the Carriage by Road Act, 2007 and the Post Office Act, 2023:
- Prepaid Digital Freight: Parcel courier fees must be paid 100% digitally at the time of booking. Couriers are strictly barred from collecting cash at pickup or doorstep.
- Consignment & Handover: The sender generates a digital consignment booking. Safe delivery is legally concluded upon verified submission of the Recipient Delivery OTP.
- Carrier Right to Inspect: Under Section 8 of the Carriage by Road Act, 2007 and Section 9 of the Post Office Act, 2023, the platform and delivery partners reserve the statutory right to request package inspection if a parcel is suspected of containing contraband, unsealed liquids, or hazardous materials.
- Carrier Limited Liability Clause: In accordance with the Carriage by Road Act, common carrier liability for loss, damage, or delay of non-commercial parcels is strictly capped at ₹1,000 or the actual documented item value (whichever is lower), unless an excess value was declared and accepted with additional transit fees.
🚫 Strict Prohibition of Illegal & Contraband Goods
Senders are strictly prohibited from consigning: (a) Narcotics, cannabis, psychotropic drugs (NDPS Act 1985); (b) Firearms, explosives, fireworks, weapons (Arms Act); (c) Alcoholic liquor or country brew without state excise permits (Bombay Prohibition Act 1949); (d) Currency notes, bullion, unsealed jewellery, stolen property, or wildlife articles. Violators face immediate account blacklisting and criminal reporting to the police.
4. Bike Taxi / Passenger Transit Safety Rules
Bike taxi operations are regulated under Section 93 of the Motor Vehicles Act, 1988, the Central Motor Vehicle Aggregator Guidelines (MVAG) 2020, and Maharashtra Aggregator directives:
- Cashless Fare Settlement: Fares are calculated digitally based on mapped road routes and deducted exclusively via online payment rails or customer digital wallet. Captains are strictly barred from asking for cash tips, offline cash fares, or meter deviations.
- Mandatory Helmet Law: Under Section 129 of the Motor Vehicles Act, 1988, wearing a BIS/ISI-certified protective helmet is strictly mandatory for BOTH the captain and the pillion passenger. The captain provides a sanitized helmet. Riding without a helmet is an offense under MV Act Section 194D and riders may decline service.
- Fleet & Vehicle Compliance: Only authorized transport vehicles registered as commercial two-wheelers (yellow plates or authorized commercial EV fleets) with valid commercial passenger insurance and fitness certificates are deployed.
- Emergency SOS 112: Both passengers and captains have access to an in-app Emergency SOS trigger connecting directly to Police Control (112) and platform safety response.
- Passenger Insurance: Every active passenger ride is covered under commercial third-party and accidental insurance up to ₹5,00,000 per passenger under MVAG guidelines.
- Surge Fare Caps: Surge pricing is strictly capped at 1.5x of base fares in compliance with Central Aggregator guidelines.
5. 100% Cashless Mandate, Payment Gateways & Digital Refunds
- Authorized Digital Payment Gateways: All payments are processed through RBI-authorized payment aggregators (e.g., Cashfree / Razorpay / NPCI UPI) complying with PCI-DSS tokenization standards.
- Zero Cash Exchange Guarantee: Customers must never tender cash to delivery riders or captains. The platform disclaims all liability for any unauthorized cash handovers, cash loans, or offline cash transactions.
- Safety & Anti-Money Laundering (PMLA): The 100% cashless model completely eliminates street robbery risks for riders, transit cash shortages, counterfeit currency circulation (IPC / BNS & RBI Clean Note Policy), and guarantees complete tax traceability under Section 9(5) CGST Act.
- Direct-to-Source Digital Refunds: Approved cancellations and order refunds are remitted directly back to the customer's original digital payment method (Source Bank Account / UPI ID) or credited instantly to the in-app wallet within 1 to 7 business days as per RBI settlement directives.
- Fair Cancellation Protection: Under Rule 6 of the Consumer Protection (E-Commerce) Rules, 2020, the platform does NOT charge cancellation fees if cancellation is necessitated by platform delay, driver non-assignment, or merchant refusal.
